It seems my facility is being sued... again. We've been sued 6 times in small claims court and we've won all 6 cases. This time a guy is suing because he didn't get a refund after he was kicked out for failing a drug test... The problem is, he wasn't entitled to a refund under the terms of the contract he signed... nor did he even ask for a refund. I expect to win this case because I have the original contract he signed where it outlines the refund policies no less than 3 times and in each case he signed that he was aware of the policy and that he agreed to it.

Well, he paid $520 for room and board on the 2nd and was kicked out on the 3rd for being positive for methamphetamines... a violation of rule #2. He's asking for the full $520 back ignoring that he was here for 2 days and the cost to us for the drug test. Our refund policy is NOT unusual... All businesses have means to recover losses such as theft. A store may have losses of 3% from theft... they just raise prices by that 3%. We'd go belly up within a year if we didn't have a way to recover or offset about $20k each year.
